{"id":1124,"date":"2024-09-09T15:00:53","date_gmt":"2024-09-09T19:00:53","guid":{"rendered":"https:\/\/websites.emerson.edu\/orcs\/?p=1124"},"modified":"2024-10-01T09:45:12","modified_gmt":"2024-10-01T13:45:12","slug":"federal-grants-and-the-fly-america-act","status":"publish","type":"post","link":"https:\/\/websites.emerson.edu\/orcs\/2024\/09\/09\/federal-grants-and-the-fly-america-act\/","title":{"rendered":"Federal Grants and the Fly America Act"},"content":{"rendered":"\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"140\" height=\"102\" src=\"https:\/\/websites.emerson.edu\/orcs\/wp-content\/uploads\/sites\/7\/2024\/09\/image.png\" alt=\"\" class=\"wp-image-1125\" \/><\/figure>\n\n\n\n<p><strong>Summary of Requirement: <\/strong>All Emerson travel that is funded by the federal government must meet the <a href=\"http:\/\/www.gsa.gov\/portal\/content\/103191\" data-type=\"link\" data-id=\"http:\/\/www.gsa.gov\/portal\/content\/103191\">Fly America Act<\/a> guidelines.&nbsp; The Fly America Act Guidelines dictate that all travel must be via a U.S. flag air carrier (including the use of <a href=\"http:\/\/www.gsa.gov\/portal\/mediaId\/177151\/fileName\/FY14_Code_Share_List.action\">code share flights<\/a>) to the furthest point towards their final destination,&nbsp;<strong><em>regardless<\/em><\/strong>&nbsp;of cost or convenience.<\/p>\n\n\n\n<p>Compliance with the Fly America Act is the responsibility of each department. All travel booked through Emerson&#8217;s preferred travel vendor (SAP Concur) will be pre-vetted for compliance with the Act, when necessary. <\/p>\n\n\n\n<p><strong>Exceptions to the Fly America Act:<\/strong>&nbsp;Travel that is to be reimbursed from federal grants and contracts must be booked through U.S. carriers except in the following circumstances:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>When the use of U.S. carrier service would extend travel time (including delay at origin) by 24 hours or more<\/li>\n\n\n\n<li>When the costs of transportation are reimbursed in full by a third party, such as a foreign government or an international agency<\/li>\n\n\n\n<li>When U.S. carriers do not offer nonstop or direct service between origin and destination. However, a U.S. carrier must be used on every portion of the route where it provides service unless, when compared to using a foreign air carrier, such use would:\n<ul class=\"wp-block-list\">\n<li>Increase the number of aircraft changes outside the United States by two or more<\/li>\n\n\n\n<li>Extend travel time by at least six hours or more<\/li>\n\n\n\n<li>Require a connecting time of four hours or more at an overseas interchange point.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p>With the many <a href=\"http:\/\/www.gsa.gov\/portal\/mediaId\/177151\/fileName\/FY14_Code_Share_List.action\" data-type=\"link\" data-id=\"http:\/\/www.gsa.gov\/portal\/mediaId\/177151\/fileName\/FY14_Code_Share_List.action\">code sharing arrangements<\/a> among airlines, compliance can be both complicated and difficult to monitor.&nbsp;&nbsp; If a traveler is flying under the Fly America Act and they select a foreign carrier, a justification form typically is completed. Some exceptions that may apply include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>When there is no nonstop or direct service offered by a U.S. carrier<\/li>\n\n\n\n<li>When travel solely outside the US increases the number of aircraft changes en route to more than two<\/li>\n\n\n\n<li>When the passenger&#8217;s travel time is extended by a least 6 hours<\/li>\n\n\n\n<li>When the connecting time is 4 hours or more at an overseas interchange point.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Open Skies Agreement<\/h2>\n\n\n\n<p>The&nbsp;<strong><a href=\"https:\/\/www.gsa.gov\/policy-regulations\/policy\/travel-management-policy\/fly-america-act#OSA\">Open Skies Agreement<\/a>&nbsp;<\/strong>is an exception to the Fly America Act.<\/p>\n\n\n\n<p>The U.S. Government has entered into several agreements that allow federal funded transportation services for travel to use foreign air carriers under certain circumstances.
